Terms of Service
Last updated: 25 October 2026
1. Purpose
These Terms of Service ("Terms") govern access to and use of the Cubrik service (the "Service"), available at cubrik.ai and operated by Next Step L.L.C-FZ ("Cubrik", "we", "us"). By creating an account you accept these Terms, the Privacy Policy and the Risk Disclosure without reservation.
2. Description of the Service
Cubrik is a software platform (SaaS) that lets users configure automated agents powered by third-party artificial intelligence models. The user connects their own third-party accounts and tools (through MCP connectors or API keys they provide), writes instructions, and defines triggers and execution limits. The agent then performs actions on those third-party accounts, on behalf of and under the sole responsibility of the user.
Cubrik is an execution tool. Cubrik makes no decisions on its own behalf, provides no advice, holds no funds and has no access to any withdrawal function on the user's third-party accounts.
3. Eligibility
The Service is available to natural persons of legal age (18 or the age of majority in their country of residence, if higher) with full legal capacity, and to legal entities represented by an authorised person.
You are solely responsible for verifying that use of the Service, and of the third-party services you connect to it, is lawful in your country of residence. The Service is not intended for residents of jurisdictions where its use would be prohibited.
4. User account
You must provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials and for all activity carried out from your account. One account per person. We may suspend or close an account in the event of a breach of these Terms, suspected fraud or legal obligation.
5. Connecting third-party accounts and API keys
5.1. You supply the API keys or connectors to your third-party accounts yourself. You represent that you are their legitimate holder or have the necessary authorisation.
5.2. You undertake to create such keys without withdrawal or fund-transfer permissions. Cubrik reserves the right to refuse or disable any key carrying such permissions.
5.3. Keys are encrypted at rest. You may revoke them at any time from Cubrik or from the relevant third-party service.
5.4. Cubrik is not a party to the contractual relationship between you and the connected third-party services (exchanges, AI model providers, etc.). Their own terms apply. Cubrik is not responsible for their availability, fees, errors or decisions (account suspension, liquidation, etc.).
6. Agent operation and user responsibility
6.1. You are solely responsible for the instructions you give to agents, the limits you set and any action executed as a result on your third-party accounts.
6.2. AI models are probabilistic: their analyses may be wrong, incomplete or inconsistent. Cubrik does not guarantee the accuracy of any analysis, the achievement of any result, or the absence of loss.
6.3. Execution limits (risk per action, daily caps, time windows, etc.) are software safeguards provided for convenience. They may fail to apply in the event of a third-party service malfunction, latency, network unavailability or exceptional market events (gaps, liquidation, trading halts). You must supervise your agents and retain the means to intervene directly from your third-party accounts.
6.4. You undertake not to use the Service to manipulate a market, circumvent the rules of a third-party platform, access accounts you do not hold, or for any unlawful activity.
6.5. You may connect an artificial intelligence application of your choice — for example Claude, ChatGPT, Cursor or Claude Code — to your Cubrik account through Cubrik's MCP server. When you do, you choose the permissions it receives: reading your account, managing your agents, and trading on the third-party accounts you connected. Within those permissions the application can act on your account as you can in Cubrik: create, change, start, pause and delete agents, run backtests, apply analysis advice and, where you granted the trading permission, place, change and close orders on your connected third-party accounts.
6.6. Actions an AI application takes through Cubrik are taken on your behalf and under your sole responsibility, as if you had taken them yourself. Cubrik adds no confirmation step of its own: where the application asks you before it acts, that question is the application's, and you may have told it not to ask. Cubrik does not control the application, the model behind it or the instructions it receives, and is not responsible for its errors, for what it decides to do within the permissions you gave it, or for what it does with the data its tools return.
6.7. No tool of Cubrik's MCP server moves money into or out of your accounts. The limits of your plan apply to what an AI application does through Cubrik as they apply in Cubrik.
6.8. You can disconnect an AI application at any time in Settings, under AI apps; its access ends immediately. Cubrik may suspend access for AI applications, or for a given application, at any time, in particular for security reasons.
6.9. Your relationship with the provider of an AI application (for example Anthropic or OpenAI) is governed by that provider's terms, and section 5.4 applies to it as to any other connected third-party service.
7. Subscription, pricing and payment
7.1. The Service is offered under the subscription plans described on the Pricing page; AI credits may also be bought once, as described in clause 7.6. Prices are exclusive of applicable taxes, in the currency indicated.
7.2. Payment is made in advance, through our payment provider, for the billing period you choose when subscribing: monthly or annual. The annual period is charged in full at the start of the period. Subscriptions renew automatically for the same period until cancelled, and you may change the billing period at any time from your account, the change taking effect as described in clause 7.5.
7.3. Cubrik charges no commission on results obtained by the user.
7.4. We may change prices with 30 days' notice by e-mail; the change applies from the next billing period.
7.5. Changing plan or billing period. An upgrade takes effect immediately. The price difference for the current month is charged in full when you upgrade — on an annual plan, the difference for each month remaining in the current period, the current month counted in full — and the new price applies from the next renewal date. Credits already used in the current month count towards the new plan's monthly allowance. A downgrade, or a move from the annual to the monthly period, takes effect at the end of the current period. Cancellation follows the Refund Policy: it takes effect at the end of the paid period, without pro-rata refund of a period already started.
7.6. Credits bought once. In addition to the AI credits included each month in your plan, you may buy AI credits by a one-time payment from the Plan page of your account. A purchase of credits is not a subscription and does not renew. Credits are sold in multiples of €5, at 1,000 credits for every €5, from €5 up to €500 per purchase, while a paid plan is in force on your account; they cannot be bought on the free Demo plan. Credits bought once do not expire and carry over from month to month; they are used only once the credits included in your plan for the current month, and any credits granted to you by Cubrik, have been used up. They have no cash value and cannot be transferred, exchanged or converted into a plan. Credits remaining when your account is closed lapse without refund, as provided in clause 8.5.
7.7. Affiliate programme. Holders of an account may join our affiliate programme and earn commissions, calculated and paid by our payment provider, on the plans bought through their links. The programme is governed by the Affiliate Terms, which apply to those who join it in addition to these Terms.
7.8. Bonus credits for referred members. An account created through an affiliate's link or code receives the bonus credits shown on the affiliate programme's pages — 1,000 credits on 24 October 2026 — when the first payment for a plan on that account is made within 60 days of its creation. The bonus is given once per account, and not to an account that was referred through a member's invitation or that belongs to the affiliate. Bonus credits are held with credits bought once: they do not expire and are used only once the credits included in your plan for the current month have been used up; they have no cash value and cannot be transferred, exchanged or converted into a plan. We may withdraw bonus credits obtained in breach of these Terms or of the Affiliate Terms. Credits remaining when your account is closed lapse without refund, as provided in clause 8.5.
8. Withdrawal right and refunds
8.1. A free plan (Demo) allows you to test the Service in full before any payment. You are expected to use it to assess whether the Service meets your needs before subscribing.
8.2. Immediate performance and loss of withdrawal right. If you are a consumer residing in the European Union or the United Kingdom, you would in principle benefit from a 14-day right of withdrawal from the date you subscribe to a paid plan. However, the Service consists of digital content and digital services that are made available to you immediately upon payment. At checkout, you expressly request that performance begin immediately, and you expressly acknowledge that, once you have accessed the Service, you lose your right of withdrawal. Your acceptance is recorded by a separate, unticked checkbox and confirmed in the order confirmation email.
8.3. No refunds. Subject to 8.2 and 8.4, all amounts paid are final and non-refundable. Any billing period that has started is due in full. You may cancel at any time; cancellation takes effect at the end of the current billing period and no pro-rata refund is granted for the remaining days.
8.4. Service unavailability. Notwithstanding 8.3, in the event of Service unavailability attributable to Cubrik exceeding 72 consecutive hours within a billing period, a pro-rata refund for the period of unavailability is granted on request to help@cubrik.ai.
8.5. Credits bought once. Credits are digital content delivered to your balance immediately upon purchase. By purchasing credits, you expressly request immediate delivery and acknowledge losing your right of withdrawal upon delivery. Purchased credits are non-refundable.
9. Termination
You may cancel at any time from your account; cancellation takes effect at the end of the paid period. We may terminate with 30 days' notice, or without notice in case of serious breach. Upon closure, your API keys are deleted from our systems within 30 days; you should also revoke them on the third-party service side.
10. Availability and changes to the Service
The Service is provided "as is". We aim for high availability without guaranteeing it. Interruptions for maintenance or technical reasons may occur. We may change, add or remove features, connectors or third-party models at any time.
11. Limitation of liability
To the extent permitted by applicable law:
- Cubrik is not liable for financial losses, loss of profit, loss of data or indirect damages arising from use of the Service, from actions executed by agents or by AI applications you connected, or from connected third-party services.
- Cubrik's total liability, on any basis, is limited to the subscription fees you paid during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms limits Cubrik's liability for fraud, gross negligence, or where such limitation is prohibited by mandatory consumer protection law.
12. Intellectual property
The Service, its code, interfaces and trademark remain the property of Cubrik. You retain ownership of your instructions and data. You grant us a limited licence to process them solely for the purpose of providing the Service.
13. Personal data
The processing of your data is described in the Privacy Policy.
14. Changes to these Terms
We may amend these Terms. Material changes are notified by e-mail or in the application at least 15 days before they take effect. Continued use constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates and the regulations of the Meydan Free Zone. Any dispute shall be submitted to the competent courts of Dubai, without prejudice to mandatory provisions applicable to consumers in their country of residence.
